Collect without damaging the relationship.

An unpaid invoice is settled more easily when the debtor is treated with respect. These are the commitments we make on every case, to our clients and to their debtors alike.

This English translation is provided for convenience. The French version (version française) prevails in the event of any discrepancy.

Himilco undertakes to charge no fees to the debtor in the amicable phase, to send letters that comply with the law, to hold clients' funds in a dedicated account, never to start legal proceedings without the client's written agreement, and to process the debtor's data solely for the purpose of collecting the claim.

Our commitments

  1. No fees charged to the debtor in the amicable phase. The costs of amicable collection remain payable by the creditor (Article L111-8 of the French Code of Civil Enforcement Procedures). We claim the debt and the penalties and indemnities provided for by law, nothing more.
  2. Clear, compliant letters. Every letter states who we are, on whose behalf we act, and the basis and detailed amount of the sum due, in accordance with Article R124-4 of the same code.
  3. Protected funds. The sums collected pass through an account dedicated to client funds, separate from our own cash (Article R124-4).
  4. No court action without your agreement. Moving to the legal phase only happens with the client's written agreement.
  5. A solution before enforcement. When a debtor acting in good faith cannot pay in one go, we look for a realistic payment plan.
  6. Respect for protective procedures. As soon as we are informed of insolvency proceedings or an admissible over-indebtedness case, we stop all reminders and follow the rules of the procedure.
  7. Protected data. The debtor's data is used only to collect the claim and is processed in accordance with the GDPR.
